Sažetak
Породица као друштвена категорија постаје све више подложна утицају друштвених мрежа, не само као целина, већ и посредством појединих чланова – пре свега родитеља и деце. Sharenting као облик вршења родитељског права представља појаву савременог доба. Одредбе о заштити детета од постављања садржаја на друштвеним мрежама садржане су у Закону о јавном информисању и медијима и Породичном закону. Поред законске регулативе која је оскудна, ни домаћа судска пракса у овој области није садржајна. Предмет анализе била је пресуда Апелационог суда у Крагујевцу о којој се изјашњавао и Врховни касациони суд. Објављивање фотографија деце на Интернету путем сервиса за друштвене мреже може да представља опасну активност које савесни родитељ треба да буде свестан. Имајући у виду то да малолетно дете, посебно до одређеног узраста (нпр. до 12 година), не може бити свесно свог дигиталног идентитета, родитељи јесу „чувари” тог идентитета, који се манифестује и кроз објављивање слика и материјала на друштвеним мрежама. Иако правни систем треба да препозна, регулише и на крају реагује на кршење права детета у дигиталној сфери, домет истог је услед константног развоја нових технологија и нових друштвених мрежа прилично ограничен.
