Abstract
Uprkos propasti Ustava za Evropu, Evropska unija ima ustav, kratka je poruka autorke ovog rada. Rad počinje kraćim osvrtom na uspone i padove u procesu konstitucionalizacije Evropske unije, a zatim se vodi rasprava o tome zašto Unija ima ustav iako nije država i nema demos. Polazeći od različitih ustavnih tradicija i francuske Deklaracije o pravima čoveka i građanina (1789), autorka, zatim, pokazuje da Unija ima antirevolucionarni, nekodifikovani i „živi“ ustav, nastao u postupku konstitucionalizacije Unije tj. ograničavanja javne vlasti pravnim normama. Tvrdeći da su krajnji ciljevi Evropskog ustava - povezivanje političkog mesijanizma (na čijoj ideji je Unija nastala) sa demokratijom i pozicioniranje EU na globalnoj političkoj sceni –u radu seanalizira Evropski ustav iz perspective demokratskog deficita i zaštite individualnih prava.Prihvatajući da nije reč o„dokumentu za laike“ nego o pravničkoj konstrukciji, autorka ukazujeda bi dalju raspravu o demokratskim postulatima u transnacionalnim političkim zajednicama trebalo viditi i izvan perspektive vestfalske države.
